These Terms of Service ("Terms") govern your use of the FitCast SMS weather forecast service operated by Trailcast LLC ("we," "us," or "our"). By subscribing to or using FitCast, you agree to these Terms.

Description of Service

FitCast is a subscription SMS service that delivers weather forecasts designed for runners. Based on the zip code you provide, FitCast sends text messages with localized weather conditions, temperature, wind, precipitation, and running-specific guidance to help you plan your outdoor activities.

Subscription Terms and Pricing

FitCast is offered as a paid subscription service:

• Price: $2.99 per month, billed annually at $35.88.
• Billing cycle: Your subscription is billed once per year on the anniversary of your sign-up date.
• Auto-renewal: Your subscription automatically renews each year unless you cancel before the renewal date.
• Payment: All payments are processed securely through Stripe. You are responsible for keeping your payment information current.

Free Trial

New subscribers receive a 7-day free trial. During the trial, you will receive FitCast messages at no charge. At the end of the 7-day trial period, your subscription will automatically convert to a paid subscription and you will be charged unless you cancel before the trial ends. You may cancel during the trial at any time with no charge.

Message Frequency

FitCast sends approximately 7 to 14 messages per month, depending on your preferences and weather conditions. Message frequency may vary. Message and data rates may apply.

Cancellation and Opt-Out

You can cancel your FitCast subscription at any time:

• Reply STOP to any FitCast text message to immediately unsubscribe.
• There are no cancellation fees.
• After cancelling, you will receive a single confirmation message and no further messages will be sent.
• If you cancel mid-billing-cycle, you will not receive a prorated refund for the remaining period.

User Responsibilities

By using FitCast, you agree to:

• Provide an accurate, valid US mobile phone number capable of receiving SMS messages.
• Provide a valid US zip code for weather forecast delivery.
• Be at least 13 years of age.
• Consent to receiving recurring automated text messages from FitCast at the phone number you provide.
• Not use the service for any unlawful purpose or in violation of these Terms.

Carrier Disclaimer

FitCast messages are delivered via SMS through supported US mobile carriers. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your mobile carrier. T-Mobile, AT&T, Verizon, and other major US carriers are supported. Carrier message and data rates may apply.

Service Availability

We strive to deliver messages reliably, but we do not guarantee uninterrupted service. FitCast may be temporarily unavailable due to maintenance, carrier issues, third-party service outages, or other factors beyond our control. We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice.

Limitation of Liability

FitCast provides weather forecasts for informational purposes only. Weather data is sourced from third-party providers and may not always be accurate or up to date.

To the fullest extent permitted by law, Trailcast LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use FitCast. This includes, but is not limited to, damages arising from inaccurate weather data, undelivered messages, or reliance on forecast information for physical activity decisions.

Our total liability to you for any claims arising from your use of FitCast shall not exceed the amount you paid for the service in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Trailcast LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of FitCast or violation of these Terms.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by text message or by posting a notice on our website. Your continued use of FitCast after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
